- INTRODUCTION

“Company” or “Whiteon Builders” refers to Whiteon Builders (Pvt) Ltd., a fast-growing construction and project management company operating in Sri Lanka, specialising in residential and commercial construction, renovations, interior design, and comprehensive building solutions.
“Client” or “You” refers to any individual, business entity, organisation, or legal entity engaging our construction, design, project management, or related services.
“Services” refers to all construction, building, renovation, project management, design consultation, bill of quantities preparation, cost estimation, interior design, and related professional services provided by Whiteon Builders.
“Project” refers to any construction, building, renovation, design, or related work undertaken by Whiteon Builders for the Client.
“Agreement” refers to the contract or engagement between Whiteon Builders and the Client for the provision of Services.
“Website” refers to whiteonbuilders.lk and all associated subdomains and pages.
- SCOPE OF SERVICES
Whiteon Builders provides comprehensive construction and project management services tailored to meet the diverse needs of our clients across Sri Lanka. Our services include, but are not limited to:
3.1. CONSTRUCTION SERVICES
- Complete residential construction (houses, villas, apartments)
- Commercial building construction (offices, retail spaces, warehouses)
- Industrial facility construction
- Renovation and remodelling projects
- Building extensions and additions
- Foundation to finishing works
3.2. PROJECT MANAGEMENT SERVICES
- End-to-end project coordination and oversight
- Construction scheduling and timeline management
- Quality control and site supervision
- Contractor and subcontractor management
- Risk assessment and mitigation
- Progress reporting and documentation
3.3. DESIGN & PLANNING SERVICES
- Architectural design consultation
- Interior design and space planning

- 3D visualisation and rendering

3.4. COST MANAGEMENT SERVICES
- Bill of Quantities (BOQ) preparation
- Detailed cost estimation
- Budget planning and cost analysis

3.5. CONSULTATION SERVICES
- Construction feasibility studies
- Technical advisory services
- Building code compliance guidance
- Material selection consultation
- Sustainability and energy efficiency recommendations
- QUOTATIONS AND ESTIMATES
4.1. All quotations are valid for 10 days from the date of issue unless otherwise stated.
4.2. Quotations are based on information provided by the Client and site inspections conducted by our team.
4.3. Final costs may vary based on actual site conditions, material price fluctuations, and changes in project scope.
- PROJECT TIMELINE
5.1. Project timelines are estimates and may be subject to change due to weather conditions, material availability, unforeseen site conditions, or changes requested by the Client.
5.2. The Company will make reasonable efforts to complete projects within the estimated timeframe.
- PAYMENT TERMS
6.1. Payment schedules will be outlined in individual project agreements.
6.2. Typical payment structure:
- Initial deposit: 40% upon agreement signing
- Progress payments: As per milestone completion
- Final payment: Upon project completion and handover
6.3. Late payments may incur interest charges as per Sri Lankan commercial practices.
- CLIENT RESPONSIBILITIES
7.1. Provide accurate information regarding project requirements.
7.2. Ensure site accessibility for workers and materials.
7.3. Obtain necessary approvals and permits from local authorities where required.
7.4. Make timely decisions on materials, designs, and changes.
7.5. Ensure timely payments as per the agreed schedule.
- CHANGES AND VARIATIONS
8.1. Any changes to the agreed project scope must be submitted in writing.
8.2. Changes may affect the project timeline and costs.
8.3. Additional charges for variations will be communicated before implementation.
- MATERIALS AND WORKMANSHIP
9.1. The Company uses quality materials from reputable suppliers.
9.2. All work is performed by qualified and experienced professionals.
9.3. Materials supplied by the Client are not covered under our warranty.
- WARRANTY
10.1. We provide a warranty on workmanship for a period of 12 months from project completion.
10.2. Manufacturer warranties apply to materials and fixtures as per their terms.
10.3. Warranty does not cover damage due to misuse, negligence, or natural disasters.
- LIABILITY AND INSURANCE
11.1. The Company maintains appropriate insurance coverage for our operations.
11.2. The Company is not liable for delays caused by circumstances beyond our control.
11.3. Client property damage will be addressed subject to our insurance policy terms.
- CANCELLATION AND TERMINATION
12.1. Either party may terminate the agreement with written notice.
12.2. Cancellation fees may apply based on work completed and materials purchased.
12.3. The Client is responsible for payment of all work completed up to the termination date.
- DISPUTE RESOLUTION
13.1. Any disputes shall first be attempted to be resolved through mutual discussion.
13.2. If resolution cannot be reached, disputes shall be resolved through arbitration in accordance with Sri Lankan law.
- INTELLECTUAL PROPERTY
14.1. Design plans and drawings remain the property of Whiteon Builders unless otherwise agreed.
14.2. The Client receives a license to use designs for the specific project only.
- PRIVACY AND CONFIDENTIALITY
15.1. We respect client privacy and maintain confidentiality of project information.
15.2. Client information is handled in accordance with applicable Sri Lankan privacy laws.

- EMAIL COMMUNICATION AND CONSENT

16.3. By engaging our services and providing your email address, you consent to receive such communications.

- FORCE MAJEURE
The Company shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, government actions, or pandemics.
- GOVERNING LAW
These Terms and Conditions are governed by and construed in accordance with the laws of Sri Lanka, and any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
- AMENDMENTS
